This User Agreement applies to the products and services provided by Fuzhou Zhihuata Nei’ou Information Technology Co., Ltd.
For convenience of expression, Fuzhou Zhihuata Nei’ou Information Technology Co., Ltd. is hereinafter referred to as “MOMO.”
MOMO hereby reminds you that before registering for or using any products or services provided by MOMO, you should carefully read and fully understand this User Agreement. By registering for or using MOMO’s products and services, you are deemed to have agreed to this User Agreement and accepted all terms and conditions herein, and you agree to be bound by this Agreement.
Before registering for or using MOMO’s products and services, please be sure to read this User Agreement carefully and fully understand all provisions, especially those provisions that exempt or limit MOMO’s liability, restrict your rights, or stipulate dispute resolution methods and jurisdiction. Clauses involving limitations of liability, disclaimers, or other matters that may materially affect your rights and interests may be highlighted in bold, underlined, or other forms to draw your attention.
This User Agreement constitutes an agreement between you and MOMO regarding the registration for or use of MOMO’s products and services. One party to this Agreement is you, and the other party is the operator of the products and services.
Any agreements, business rules, or related content published by MOMO on its official website or official app shall be deemed as supplementary agreements to this User Agreement. Once formally published, such content shall form an integral part of this User Agreement, and you shall also comply with them.
You agree and authorize MOMO to collect user information for the purpose of performing this Agreement. Such information includes, but is not limited to:
MOMO’s collection of your user information shall comply with this Agreement and applicable laws and regulations.
We will use the collected information in accordance with the following principles:
We will not combine information stored in analytical software with your personally identifiable information.
We will use the collected information only within the scope covered by this Agreement. If we intend to use your personal information beyond the purpose stated at the time of collection or beyond a directly or reasonably related scope, we will inform you again and obtain your explicit consent before such use.
Protecting user information and privacy is a fundamental principle of MOMO. Unless otherwise provided in this Agreement, MOMO’s collection, use, and protection of user information shall comply with this Agreement and relevant laws and regulations.
Except as otherwise provided by law, if you have agreed or authorized MOMO to collect, use, or process your personal information in accordance with this Agreement, withdrawal of such consent or authorization shall not affect the validity of personal information collection, use, or processing already carried out by MOMO prior to such withdrawal.
MOMO undertakes not to modify users’ personal information, or edit or disclose users’ passwords, names, addresses, phone numbers, identification numbers, or non-public content stored in MOMO, unless disclosure is required by law or MOMO, acting in good faith, believes that disclosure is necessary under the following circumstances:
MOMO provides both free and paid products and services through websites, apps, and other means. You acknowledge and agree that changes or adjustments to paid services or pricing standards are normal commercial practices, and you shall not demand compensation or reimbursement from MOMO due to such changes or adjustments.
The MOMO Echo app is an application designed to help users train English listening skills. It includes a large amount of English listening materials and is continuously updated.
During your use of MOMO’s products and services, MOMO may provide corresponding operational settings as appropriate, allowing you to view, delete, correct, or withdraw your relevant personal information, or to cancel your account and all related information through account cancellation functions or customer service channels provided by MOMO.
MOMO also provides complaint and reporting channels, and your feedback will be handled in a timely manner.
MOMO reserves the right to restrict functions or terminate services for users who seriously violate this User Agreement or applicable laws and regulations. If a user causes significant impact or economic losses to MOMO through abnormal or improper means, MOMO reserves the right to pursue legal liability.
All learning content built into the MOMO Super Listening app is carefully edited and selected by MOMO and constitutes MOMO’s intellectual property. MOMO reserves all related rights.
MOMO makes every effort to ensure the security of your data. However, MOMO shall not be liable for any data loss or leakage caused by force majeure events, including but not limited to natural disasters, wars, or national policy adjustments.
If data damage, data loss, or software unavailability results from your use of MOMO through abnormal means (such as using external tools to modify data or reverse engineering), MOMO reserves the right to refuse to provide any repair or recovery services. If such abnormal behavior causes significant impact or economic losses to MOMO, MOMO reserves the right to pursue legal liability.
MOMO has the right to impose operational restrictions on accounts that obtain improper benefits through abnormal means. Such restrictions may include freezing all account functions. If such abnormal behavior causes significant impact or economic losses to MOMO, MOMO reserves the right to pursue legal liability.
The content sharing function is a sharing service provided by MOMO to continuously deliver better content. If you abuse the content sharing function and cause a decline in system content quality, MOMO reserves the right to restrict your account, which may include freezing all account functions.
